California State Senator Sabrina Cervantes will not face DUI charges following a Sacramento car accident, after tests showed no signs of intoxication.
The Sacramento County District Attorney’s Office announced Friday that a blood test taken on the day of the crash was “negative for any measurable amount of alcohol or drugs.”
After reviewing police reports, witness statements, and lab results, prosecutors decided not to file charges, citing the burden of proof required in a criminal trial.
Cervantes, a Riverside County Democrat, was driving on a through street when another car, stopped at an intersection, slowly accelerated and collided with her vehicle, according to nearby security footage.
Initially, Sacramento police cited Cervantes for DUI after the May 19 collision, suspecting drug impairment rather than alcohol. Cervantes denied the accusation, calling police treatment at the hospital “accosting.” She also provided a urine test from the day after the crash showing no detectable drugs.
Police said officers observed signs of impairment but didn’t release further details. Cervantes declined a field sobriety test, prompting officers to seek a warrant for a blood test, which she voluntarily submitted.
In a statement, Cervantes said, “I did absolutely nothing wrong, and the Sacramento District Attorney’s Office has now affirmed as much. This ordeal was unnecessary and caused my family and me enormous stress and pain. No one deserves this.”
Despite initial suspicion, the evidence cleared Cervantes, ending a case that stirred controversy and tension near the Capitol.
